In light of the success we witnessed in the security around WikiLeaks, hopefully controls will be in place to ensure inadvertent disclosures are minimized and carefully reviewed before levy of fines... I can see where this sort of information could be used improperly so safeguards and punishment needs careful use. Ruining a persons good name for personal gain is not acceptable. Once a person has met society's corrective action, should this data be expunged or placed into the public domain. Rather, I believe this is responsibility of those creating these records to protect. Closed systems and proper security... an "eyes only" environment where documents cannot be "spirited" away in someone's clothing.
